1. Agreement to Terms

Welcome to Fasting Works! These Terms of Service ("Terms") constitute a legally binding agreement between you and Tab0, Inc. ("Company," "we," "us," or "our") governing your access to and use of the Fasting Works mobile application, website, and related services (collectively, the "Services").

By downloading, installing, or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our Services.

2. Description of Services

Fasting Works provides the following features:

  • Fasting Tracking: Tools to track and monitor your intermittent fasting sessions
  • Nutrition Tracking: Features to log and analyze your food intake and nutritional data
  • AI-Powered Insights: Artificial intelligence-based analysis and recommendations for nutrition and health patterns
  • Health Integration: Integration with Apple HealthKit to sync data including weight, water intake, and calorie information

We reserve the right to modify, suspend, or discontinue any part of the Services at any time without prior notice.

3. Health and Medical Disclaimer

IMPORTANT: The Services are intended for general health, fitness, and wellness information purposes only.

NOT A MEDICAL DEVICE: Fasting Works is not a medical device and is not regulated by the FDA or any health authority. The Services are not intended to diagnose, treat, cure, or prevent any disease or medical condition.

  • The Services do NOT provide medical advice, diagnosis, or treatment.
  • Information provided through the Services should NOT be used as a substitute for professional medical advice.
  • The Services are designed to support general wellness and weight management goals, not to provide medical treatment or weight loss prescriptions.
  • Always consult with a qualified healthcare provider before starting any fasting regimen, making dietary changes, or if you have any health-related questions.
  • We do not employ licensed physicians or medical professionals to provide health advice through the Services.
  • If you experience any adverse health effects while using our Services, discontinue use immediately and consult a healthcare professional.

IF YOU ARE EXPERIENCING A MEDICAL EMERGENCY, CALL 911 (US), 119 (Korea), OR YOUR LOCAL EMERGENCY NUMBER IMMEDIATELY.

4. Eligibility and Account

To use our Services, you must:

  • Be at least 18 years of age, or the age of majority in your jurisdiction
  • Have the legal capacity to enter into a binding agreement
  • Not be prohibited from using the Services under applicable law

If you create an account, you are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information when creating your account and to update such information as necessary.

5. Subscriptions and Payments

Some features of the Services may require a paid subscription. Subscriptions are processed through Apple App Store or other authorized platforms.

  • Automatic Renewal: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
  • Cancellation: You may cancel your subscription at any time through your Apple ID account settings or the platform through which you subscribed. Cancellation will take effect at the end of the current billing period.
  • Refunds: Refunds are subject to the policies of Apple App Store or the applicable payment platform. We do not directly process refunds.
  • Price Changes: We reserve the right to change subscription prices. Any price changes will be communicated in advance and will apply to the next billing cycle.
  • Korean Users - Withdrawal Rights: For users residing in the Republic of Korea, you have the right to withdraw from a subscription within 7 days of purchase for unused digital content, in accordance with the Act on Consumer Protection in Electronic Commerce. This right applies in addition to the cancellation rights provided by Apple App Store.

6. User Content and Data

You retain ownership of any content you submit through the Services (including fasting logs, nutrition data, and other personal information). By using the Services, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and process your content solely for the purpose of providing and improving the Services.

You agree not to submit content that:

  • Is unlawful, harmful, threatening, or harassing
  • Infringes on intellectual property rights of others
  • Contains malicious code or software
  • Violates any applicable laws or regulations

7. Apple HealthKit Integration

If you choose to connect the Services to Apple HealthKit, you authorize us to access and use certain health data as described in our Privacy Policy. You can revoke this access at any time through your device settings.

Specific HealthKit Data Usage: We access the following HealthKit data types solely for the purposes stated:

  • Active Energy and Dietary Energy: Used exclusively to calculate and display your net caloric balance
  • Water/Hydration: Used exclusively to display your daily water intake levels
  • Body Mass (Weight): Used exclusively to track weight trends in relation to your fasting and nutrition goals

We collect only the minimum necessary HealthKit data required to provide the core functionality of our Services. We will NOT use your HealthKit data for advertising or marketing purposes, and we will not share your HealthKit data with third parties for their marketing purposes, in compliance with Apple App Store Guidelines 5.1.3(i).

8. AI-Powered Features

Our Services include AI-powered features for nutrition analysis and recommendations.

How Our AI Works

Our AI analyzes your food logs and nutrition patterns to identify trends and provide personalized suggestions. The AI uses probabilistic models and general nutritional guidelines (based on USDA standards) to generate insights. However, the AI does not have access to your complete medical history and cannot account for individual health conditions, allergies, or specific medical needs.

Cloud Processing: When you use AI features, your nutrition and health data may be securely transmitted to and processed by third-party AI service providers in the cloud. This data is anonymized where possible and used solely to generate your personalized insights.

You acknowledge and understand that:

  • AI-generated insights are generated probabilistically and may contain inaccuracies or errors
  • AI suggestions are for informational and wellness purposes only and should not be treated as professional medical or nutritional advice
  • AI outputs may be inaccurate, incomplete, or inappropriate for your specific situation
  • You should always verify AI-generated recommendations with qualified healthcare or nutrition professionals

9. Intellectual Property

The Services, including all content, features, and functionality, are owned by Tab0, Inc. and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Services without our prior written consent.

10. Prohibited Uses

You agree not to:

  • Use the Services for any unlawful purpose
  • Attempt to gain unauthorized access to any part of the Services
  • Interfere with or disrupt the Services or servers
  • Reverse engineer, decompile, or disassemble the Services
  • Use automated systems to access the Services
  • Impersonate any person or entity
  • Collect or harvest user data without authorization

11. Third-Party Services

The Services may integrate with or contain links to third-party services, including Apple HealthKit and cloud service providers. We are not responsible for the content, privacy policies, or practices of any third-party services. Your use of third-party services is at your own risk and subject to the terms and conditions of those services.

12. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Services will be uninterrupted or error-free
  • The Services will meet your specific requirements
  • The results obtained from the Services will be accurate or reliable
  • Any errors in the Services will be corrected

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TAB0, INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US FOR THE SERVICES IN THE SIX (6) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

14. Indemnification

You agree to indemnify, defend, and hold harmless Tab0, Inc. and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Services, violation of these Terms, or infringement of any rights of another.

15. Termination

We may terminate or suspend your access to the Services at any time, with or without cause, and with or without notice. Upon termination, your right to use the Services will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

16. Governing Law and Dispute Resolution

General Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Savings Clause for Korean Users: Notwithstanding the above, for users residing in the Republic of Korea, where mandatory provisions of Korean consumer protection laws (including the Personal Information Protection Act, the Act on Consumer Protection in Electronic Commerce, and other applicable Korean laws) conflict with California law or these Terms, such Korean laws shall prevail to the extent required by law. Disputes involving Korean residents may be resolved in the courts of the Republic of Korea at the user's option.

For users in other jurisdictions: The governing law shall be determined based on your place of residence, to the extent required by applicable law.

17. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you through the Services or by other means. Your continued use of the Services after such notification constitutes your acceptance of the modified Terms.

18. General Provisions

  • Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Tab0, Inc. regarding the Services.
  • Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
  • Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
  • Assignment: You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
